The fee schedule for Green Card through EXCEPTIONAL ABILITY ALIEN (Schedule A- Group II, fees are payable by personal checks) is as follows:

1. Legal Fees (for our Office):

$5,400 including spouse and children, $4,600 at the commencement of the case and $800 at the time of the preparation of I-485

2. Filing Fees( to the USCIS): Single Applicant
  I-140: $580
  I-485, I-765, I-131, Fingerprinting: $1070
3.

Federal Express Expenses: approximately $200


Note: The filing fee of $1070 includes fee for applications I-485, I-765, I-131 and finger printing irrespective of whether I-765 and I-131 applications are submitted along with I-485.

I-140 priority date porting

Hi,

My PERM and I-140 was approved by previous employer with PD of Jan 2009. Left him without filing I-485 and he withdrew the I-140 application. Went back to India and joined another company. They transferred me to US this year and starting my GC process again from PERM. Will I be able to port the PD from previous approved I-140 ??

I have a copy of previous approved I-140. If yes, How long will the entire process take.
Have you ever dealt a case like this before and what is your success rate..

I-140 priority date porting

USCIS has flip flopped on this issue. Their current "flop" is that if the I-140 is revoked (AC21 portability being an exception), then the PD cannot be transferred. We can try, but I do not have much hope for success. They changed their minds without notice earlier on this issue, who knows when they might do it again.

NIW for Entrepreneurs

I am BSC (pathology)(3)yrs course +1 yr computer certification and certification for MCP (Microosft certified profession). I am on L2B visa. I have started my company in US in 2008 in Microsoft training. I have trained many candidates (GC, citizens and EAD) who got the job after our training. Please let me know If I am eligible for EB2 NIW for entrepreneurs. I am the single employee of my company. I am in Seattle, WA. Since Microsft head office is in redmond so my training really helped to many candidates to get the job.

Pls confirm If I can apply for EB2 NIW entrepreneurs.

Right now, there is only a theoretical nod from the govt. We have been given no practical guidelines.

EB2- I824

Hi Rajiv,
After leaving US, I abandoned the I485 petition under EB2. My company is willing to bring me back and has filed an I824 application on an approved I140. My company filed the I824 in April, 2011 and current processing time has beyond my filing date i.e. USCIS is processing August,2011 applications at I write. There is no definite answer from them as to when the case will be transferred. Is there anything that can be done?

EB2- I824

Not unless the times being taken by USCIS exceed their normal processing times. But you can always enter using H-1 visa in the interim. Thereafter, you can file for AOS or continue with the consular processing.

I-485 Filing

I have I-140 approved and as of Feb12 VB I am current now. I am trying to find out good and reliable attorney service for filing the I-485, EAD and Advance Parole. I have two dependents (Wife and daughter) for whom also I need to file the same along with my application. Could you please let me know how much it will cost and the procedure to start the process. I would really appreciate if you can let me know these at your earliest convenient time.

EB3 to EB2

Hi Rajiv,

I have a question , My Labour is filed in EB3 & my PD is oct-2003 . I got my EAD in 2007 . I have a BE degree from india & a work experince of 13 years . 5 in India & 8 in USA . am i eligible for porting to EB2 . if i file a fresh EB2 what is the process? is it just the Perm process & I- 140 or do i need to file a I 485 again . what would be the cost for doing this porting/filing EB2 ? Please advise .

EB3 to EB2

People with over 5 years of exp. after a 4-year degree may be ale to restart the green card under EB2 category and then port their PD. Basically, you are redoing the PERM and I-140 for an EB2 level job.
