If I-140 denied with pending I-485, can I switch to I-130?
Hi, my I-140 for extraordinary ability was denied 2 days ago. I had a concurrent filing of the I-485. Since the time I filed both these forms, I got married to a US Citizen. I am currently using the EAD from the concurrent I-765 filing. Is it possible that I apply for the I-130 now and continue to work on the same EAD? Do I need to file I-485 and I-765 again? Any other issues I need to worry about regarding my legal status? Any advice will be much appreciated!! Thanks.

Worked more than 20 hours on an F1 visa-Impact on GC Application
In 2004, I applied for & received a 1 year EAD (due to economic hardship) while I was an F1 student. The EAD card stated that I could only work for 20hrs during school. However, I exceeded the 20 hours limit during school for ~5-7 months. Also, the company I was working for was shut down & all employees were told to apply for unemployment insurance (UI was being deducted from my paychecks). I filled out the UI app,sent it in with my EAD card, received benefits for 4-6 weeks. In 2012, my PERM is approved & I140&I485 are ready to be sent to USCIS. Would anything I mentioned impact my GC app?

It can, but this is not an unmanageable issue. Speak with your lawyers and do some research on Section 245(K).

I have my I-140 approved and I also have my I-485 filed and pending under EB3 category. I changed jobs 2 years ago but I did not know that I needed to let USCIS know about this situation.
My I-140 sponsor employer did not revoke and won't my I-140. What should I do? Should I inform USCIS or just wait?

There is no law that requires you to inform USCIS. Read my blog entries on AC21 portability. I would suggest getting a lawyer and filing now. No problem.

Do I have a chance to get approved for I 140, if my employer has lost profit? I means the financial status is not quit good but he has a good credit.

Only your own lawyer or we, after reviewing the case, can answer that question. Generally speaking, if you have been getting the green card wage from the date the green card was filed, you can still get I-140 approval even if the tax returns show loss.

Approved I140 changed from EB2 TO EB3
My I140 was approved in EB2 category in 2009, now when i Priority date became current they changed my approved I140 to EB3 category.My employer/Attorney are saying its coz of my Education B.Sc(3 years) + 2 Masters.Even though we had submitted Education Evaluation to Masters of US. What are my options???Is thr any way i can file for Appeal or can your law firm help in filing appeal.
