Immigration through Employment 

One of the ways a foreign national (alien) can become a permanent resident is through a permanent employment opportunity in the United States. There are five employment-based preference categories.

  • First preference is for priority workers including persons of extraordinary ability, outstanding professors and researchers, and multinational organization executives and managers.
  • The Second preference is for members of the professions holding advanced degrees or persons of exceptional ability.
  • The Third preference is for professionals, skilled and other workers.
  • The Fourth preference provides for special immigrants including religious workers.
  • The Fifth preference is an investor-related category, which grants permanent residency to persons who invest significant funds in the US and create 10 jobs for US workers.

Issue at Port of Entry using Advance parole

Hi Rajiv,

Hope you doing well. I have valid H1b visa till Mar-2013. I got EAD and AP with EB2 category. I am planning to go India for my marriage next week for 1 month but my project is over today. I don’t have client letter or contract. I have employment letter of my employer. Will it crate any issue at Port of Entry if I don’t have project on my hand when I return from India using Advance parole?

Please advice me for the same.
